1. Controller of the processing of personal data

[email protected] (hereinafter - KH Energy).
2. Purpose of the privacy policy
The purpose of the Privacy Policy is to provide the natural person - KH Energy client, business partner, employee, job candidate - with information on the purpose, scope, protection, duration of processing of personal data and the rights of the data subject at the time of obtaining the data, as well as during the processing of personal data.
3. Applicable lawRegulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter - the Regulation); Law on the Protection of Personal Data.
4. Personal data processed by KH EnergyThis Privacy Policy applies to all personal data that you provide to KH Energy or that KH Energy obtains in connection with your interaction with KH Energy. Personal data is any information about an identified or identifiable natural person, whether a customer, employee, job applicant, business partner or their employee of KH Energy. KH Energy processes the following categories of personal data: personal identification data, general information and contact details - name, surname, personal identification number, date of birth, address, telephone number, e-mail address, institution, company name, position, CCTV data (image), data submitted in the framework of the establishment and/or implementation of cooperation based on a purchase contract, supply contract, public procurement contract, etc.KH Energy shall protect the information you provide to KH Energy, including information that KH Energy has obtained about you from other parties. For the purposes of this Privacy Policy, "personal data" means any information relating to you which enables you to be identified, directly or indirectly (in particular by your name, personal identification number, date of birth, address, telephone number, e-mail address), and any other information relating to you which is derived from such information relating to you. For example, if you send your CV to KH Energy to apply for a job, KH Energy will only use the information you provide for the purpose for which it is intended, i.e. to assess whether your candidature is relevant to the current vacancy. By providing KH Energy with your personal data, you acknowledge that KH Energy processes your personal data in accordance with the Regulation, this Privacy Policy and applicable and binding laws and regulations in the Republic of Estonia.
5. Processing of personal data KH Energy
- Objective - Conclusion and performance of a distance contract; Legal basis - Conclusion and performance of the contract; Storage period - until the end of the product warranty.
- Objective - keeping supporting accounting documents for your payments;
Legal basis - legal obligation; Retention period: *We will keep the supporting documents containing your data in paper form for 5 years and 7 months; *We will keep your data resulting from the supporting documents in an electronic accounting system for 10 years.
- Objective - Ensuring the right of withdrawal procedure; Legal basis - legal obligation; Retention period - until the right of withdrawal procedure has been completed.
- Objective - Verification of your identity and authority when you act on behalf of the principal and provision of evidence of your right of representation in the performance of the transaction; Legal basis - performance of the contract; Retention period: *Paper supporting documents with your data are kept for 5 years and 7 months; *In the electronic accounting system your data resulting from supporting documents will be kept for 10 years; *Power of attorney (original/copy) is kept for 10 years.
- Objective - KH Energy Provision of an additional service (e.g. delivery of goods); Legal basis - conclusion and performance of a contract; Storage period - 2 months after the date of creation of the relevant offer or 3 months if the payment period for the offer is extended at your request.
- Objective - Communication with KH Energy cooperation partners; Legal basis - conclusion and execution of the contract; Storage period - until execution of the contract.
- Objective - Provision of evidence in case of potential disputes arising from contracts concluded with KH Energy business partners; Legal basis - legitimate interest (protection of KH Energy's legitimate interests in a potential dispute with KH Energy business partners); Retention period - 10 years after contract performance.
- Objective - Handling your enquiries and applications (to enable SOLAR MASTER to handle your request for an exchange and/or refund; Legal basis - legal obligation under the Consumer Rights Protection Law
Retention period: 10 years from the date of receipt of the claim/request/request/submission.
- Objective - Assessment of the candidate's candidature; Legal basis - Consent; Retention period - until the conclusion of an employment contract with you or another candidate, or until your consent is withdrawn.
- Objective - KH Energy's right to protection of property and to obtain evidence" Legal basis - legitimate interest (exercise of KH Energy's legitimate interest - right to protection of property and to obtain evidence); Storage period: *90 days in accordance with the company's inventory procedure; *in the event that an infringement of KH Energy's property rights is detected and the video recording is necessary to obtain evidence, the video recording shall be stored for the duration of the investigation of the offence.
- Objective - Customer service quality assurance (recording of telephone conversations); Legal basis - legitimate interest (ensuring customer service quality); Duration of storage - 30 days.
- Objective - Conduct of marketing activities; Legal basis - consent; Storage period - until the end of the marketing campaign or withdrawal of consent. If necessary, KH Energy may keep your personal data after you have ceased to be a customer, business partner, contact person, etc. of KH Energy. This may be necessary if required by the laws and regulations in force and binding in the Republic of Latvia and in order to safeguard KH Energy's legal interests in the event of a dispute between you and KH Energy. KH Energy will not retain your personal data for longer than is reasonably necessary having regard to the purpose for which the data was collected. We cannot accept your order, sell your product, refund your money or consider your application for a position at KH Energy if you refuse to provide us with your personal data.
6. Other purposes of processingKH Energy processes personal data in specific cases not specified above, informing the data subject of the purpose of the processing at the time of acquisition of the data. For example, from time to time KH Energy may organise surveys, customer days and similar events where personal data may be processed. Processing of personal data may also be carried out in exceptional circumstances in order to protect your vital interests as a data subject or a third party.
7. KH Energy transfer of personal dataKH Energy shall not disclose to third parties the Customer's personal data or any information obtained during the purchase and the performance of the contract, except:
1) where the third party concerned is required to transfer the data within the framework of a contract for the performance of a function necessary for the performance of the contract or delegated by law (e.g. to a bank for settlement purposes, as part of a guarantee service, or for the purposes of the delivery of goods using the third party's transport services);
2) with the Client's express and unambiguous consent;
3) video surveillance in the KH Energy warehouse (for the security service provider);
4) to the persons provided for in external normative acts upon their justified request, in the manner and to the extent provided for in external normative acts;
5) in cases provided for in external regulatory enactments for the protection of KH Energy's legitimate interests, e.g. by taking legal action against a person who has infringed KH Energy's legitimate interests in court or before other public authorities. In cases where KH Energy may suffer damages as a result of the non-performance or improper performance of your obligations, KH Energy has the right to apply to the courts, the National Police, insurance providers, transfer data on your outstanding obligations to debt collection service providers, as well as to legal service providers.

The legal basis for the processing of personal data in this context is Art. 6 (1) lit. c GDPR and Art. 6 (1) lit. f GDPR. Our legitimate interests include the management of the cookies and similar technologies used and the related consents.
The provision of personal data is neither contractually required nor necessary for the conclusion of the contract. You are under no obligation to provide personal data. If you do not provide personal data, we will not be able to manage your consent.
9. Data securityKH Energy observes and has implemented appropriate technical and organisational measures to ensure maximum protection of personal data against unauthorised disclosure or access, accidental or unlawful loss, destruction or alteration, and any other unlawful processing.
10. Consent and data subject rightsAs a data subject, the customer has the following rights:
1) withdraw your consent to the processing of your personal data at any time. Withdrawal of consent shall not affect the lawfulness of processing based on consent prior to the withdrawal;
2) to access their personal data (to obtain personal data held by KH Energy, to find out the purpose and basis of processing);
3) request that KH Energy rectify or erase your personal data;
4) request a restriction on the processing of your personal data;
5) object to the processing of your personal data;
6) Request that KH Energy provides you with information about exactly what information KH Energy processes about you. You also have the right to obtain copies of documents containing your personal data free of charge. KH Energy may not comply with your request if it puts at risk the rights of others or if your request is unreasonable, repetitive or requires disproportionate effort and resources from KH Energy. KH Energy is in any case subject to the laws in force and binding in the Republic of Estonia which may prohibit KH Energy from erasing information about your personal data. You are obliged to provide information to KH Energy in the event that the personal data you have previously provided to KH Energy (e.g. your name) has changed, or if you have established that your personal data processed by KH Energy is inaccurate or out of date. We make every effort to protect your personal data that we hold. However, if you have questions/comments/requests/submissions regarding the processing of your personal data or you believe that KH Energy has violated your rights, you have the right to submit the relevant request/submission to KH Energy's office or send a submission signed with a secure electronic signature to KH Energy's e-mail address or a paper submission by post to KH Energy's registered office.
11. Changes to the Privacy PolicyKH Energy may change and update this Privacy Policy at any time.KH Energy will indicate on its website the date on which the Privacy Policy was last updated. Historical versions of this Privacy Policy may be obtained by contacting KH Energy at the contact details provided.
